CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION RETURN CONDITIONS

GENERAL:

1. When you place an order electronically through the website you are using, you are deemed to have accepted the pre-information form and the distance sales agreement provided to you.
2. Buyers are subject to the provisions of the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188), along with other applicable laws, regarding the sale and delivery of the purchased product.
3. Shipping costs, which are considered product shipment expenses, will be paid by the buyers.
4. Each purchased product will be delivered to the person and/or organization at the address indicated by the buyer within a period not exceeding 30 days from the date of purchase. If the product is not delivered within this period, the buyer may terminate the contract.
5. The purchased product must be delivered complete and in accordance with the specifications indicated in the order, along with any documents such as the warranty certificate and user manual, if applicable.
6. If it becomes impossible to sell the purchased product, the seller must notify the buyer of this situation in writing within 3 days of learning about it. The full amount must be refunded to the buyer within 14 days.

IF THE PURCHASED PRODUCT PAYMENT IS NOT MADE:

7. If the buyer fails to pay the product price or cancels the payment through bank records, the seller’s obligation to deliver the product will cease.

PURCHASES MADE WITH UNAUTHORIZED USE OF A CREDIT CARD:

8. If it is determined that the buyer’s payment card has been used fraudulently by unauthorized persons after the product has been delivered, and the payment for the product is not made to the seller by the relevant bank or financial institution, the buyer is obligated to return the product to the seller within 3 days, with the shipping cost to be covered by the seller.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEABLE REASONS:

9. If unforeseen force majeure circumstances occur that prevent the seller from delivering the product on time, the situation will be communicated to the buyer. The buyer may request cancellation of the order, replacement of the product with a similar one, or postponement of delivery until the obstacle is resolved. If the buyer cancels the order, and the payment was made in cash, the buyer will be refunded the amount within 14 days from the cancellation. If the payment was made by credit card, and the order is canceled, the product price will be refunded to the bank within 14 days, but it may take 2-3 weeks for the bank to transfer the funds to the buyer’s account.

BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

10. The buyer must inspect the product before accepting delivery. If the product is damaged (e.g., crushed, broken, torn packaging, etc.), the buyer should not accept delivery from the shipping company. The product will be deemed undamaged and intact once it is accepted. After delivery, the buyer is responsible for taking care of the product. If the right of withdrawal is to be used, the product must not be used, and the invoice must be returned with the product.

RIGHT OF WITHDRAWAL:

11. The buyer may exercise the right of withdrawal from the contract without any legal or financial responsibility and without giving any reason, by notifying the seller via the contact details below within 14 (fourteen) days from the delivery date of the product to the buyer or the person/organization at the address specified by the buyer.

RIGHT OF WITHDRAWAL PERIOD:

13. If the product is a service, the 14-day period starts from the date the contract is signed. In service contracts where the consumer has consented to the commencement of the service before the expiration of the withdrawal period, the right of withdrawal cannot be exercised.
14. Costs arising from the exercise of the right of withdrawal will be borne by the seller.
15. To use the right of withdrawal, the buyer must notify the seller in writing (via registered mail, fax, or email) within 14 days. The product must not have been used as per the conditions in the "Products for Which the Right of Withdrawal Cannot Be Used" section of this agreement.

USE OF THE RIGHT OF WITHDRAWAL:

16. The invoice of the product delivered to the buyer or a third party must be returned (If the product invoice is issued by a company, the return must include the return invoice issued by the company). Returns without the return invoice cannot be completed for orders issued in the name of institutions.
17. The returned product must be complete, undamaged, in its original box, with packaging and any standard accessories, if applicable.

RETURN CONDITIONS:

18. The seller is obligated to refund the total amount and any documents that financially burden the buyer within 10 days after receiving the withdrawal notice and to receive the returned product within 20 days.
19. If the value of the product decreases due to the buyer's fault, or if it becomes impossible to return the product, the buyer is obliged to compensate for the seller's damages in proportion to their fault. However, the buyer will not be held responsible for changes or damages caused by the proper use of the product within the withdrawal period.
20. If the withdrawal right is exercised and the value of the seller's promotional offer drops below the campaign limit, the discount received under the campaign will be canceled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED:

21. Products that have been prepared according to the buyer's specifications or are personalized and are not suitable for return, such as lingerie, swimsuits, makeup products, disposable items, goods subject to rapid deterioration or with an expiration date, products that cannot be returned for hygiene or health reasons once opened, products that are mixed with other products and cannot be separated due to their nature, periodicals such as newspapers and magazines, electronic services or intangible products delivered immediately to the consumer, and audiovisual recordings, books, digital content, software programs, data storage devices, office supplies, and products whose packaging has been opened cannot be returned. Furthermore, the right of withdrawal cannot be exercised for services that have started to be performed with the consumer's consent before the expiration of the withdrawal period.
22. Cosmetics, personal care products, lingerie, swimsuits, books, copyable software and programs, DVDs, VCDs, CDs, cassettes, and stationery materials (toners, cartridges, ribbons, etc.) can only be returned if their packaging remains unopened, they have not been used, or damaged.

DEFAULT AND LEGAL CONSEQUENCES:

23. If the buyer defaults on a payment made by credit card, the buyer acknowledges, declares, and undertakes that they will pay interest according to the credit card agreement between the buyer and the bank, and be responsible to the bank. In this case, the relevant bank may take legal action and demand legal fees and expenses from the buyer, and in any case of default, the buyer agrees to pay the seller’s damages caused by the delayed performance of the debt.

24. Payments can be made via bank transfer or EFT (Electronic Fund Transfer) to our accounts at ............, ........., bank in any of our TL accounts.
25. You can also pay using your credit cards on our site, with the option for single payments or installments. For online payments, the amount will be charged to your credit card upon completing the order.
